I graduated with a BS in Physics from the State University of New York at Albany,
in 1995. I have been studying at Western Washington University since 2003 also
doing my own research. I take a class offered by Western, this affords me access
to their library and classrooms after hours where I do most of my work.

Two Western police officers came into the classroom I was in TWO WEEKS BEFORE
Memorial Day weekend 2006, asked me for my ID and I gave it to them. I informed them
I was a student and I plan to be in this classroom doing my work for the rest of the
school year - They left me alone to continue my studies and work!

Then, two week later, on Memorial Day weekend, I had just finished writing
a technical paper titled: "The Algorithm of Virtual Machines", it
was past midnight at classroom "23" in the basement of the new communications
building the same two campus police came in and give me a trespass,
and my first citation of $500.

I went to Western Police Headquarters to speak to either the police chief
or the President of the university, Karen Morse, because a student who
had paid tuition should not to get trespassed and asked to leave school property.

At the headquarters, the police officer said, if you do not leave school property,
he would have to put me under arrest. I said "fine", so he handcuffed me, read
me "my rights" and took me to county jail, where I was processed.

When I was released the next day, I immediately went back to Western, where I
emailed every Western police officer, I could and after the library closed,
went down to Campus Services (University Police Headquarters) to address
this issue.

This time, I was not let into the building, but a Western Police officer met
me outside and handcuffed again, was given another citation for $500, and
was escorted off campus property.

That night was the last time I have been on Western Washington University's property.

I sent a certified mail filing a formal complaint to the president of
Western Washington University, the police chief of the University Police.

against ... Western Washington University.

I was thrown into prison for studying, after running into the same university police
officer, [ XXXX ], up to 5 times in one school year. Wherein he waited until
Memorial Day Weekend to show this very unacceptable behavior from a person trusted
by The University and Students.

I am a legal student at Western Washington University, with a valid Student ID �
valid until September 2006. I am taking a 1 credit course at Western under their
INDEPENDENT LEARNING PROGRAM......

Western Washington University Police Officer in Charge, [ xxx ] ,
gave me a Trespass, on May 27, 2006 and then turning around,
that same day, handcuffed me and put me in jail over the Memorial Day Weekend. .....

To make this point clear: I have run into the same police [ xxx ] 5 times this school
year and on the fifth time, he gives me a �Trespass�. I proceeded immediately to
their office and requested they call Western President, and their Police Chief for
this outrage, they went ahead and handcuffed me, read me �my rights� and sent me to jail.

I did not get a response.

The following was Western Washington University's position on this matter, this
is an email my attorney for this trespass case sent to me:

Dear Mr. (xxxxx),

I spoke to the prosecutor and he is unwilling to consider my proposal
of allowing you access to the campus with restrictions. He says he is
unable to enter into that agreement because he does not have the
authority from the University to allow you on campus. The University is
also intent on banning you access despite your need to pursue your
research. The prosecutor has suggested to enter into a agreed order of
continuance for a year in which if in that year you do not violate the
University's request to stay off campus, he will drop the charges.
However, I want you to clearly understand you CANNOT have any contact
with WWU in that time or after that time. It may be a good idea to
research alternative universities where you can continue your research
unbothered, just remember to not be on campus or in a classroom with the
express permission of the school. Please let me know if you want to
accept the state's offer of an agreed order of continuance.

As of September 5, 2006, the one year "no contact" with western went into
effect.
